Tort Claim Forms and Administration
Claim forms cannot be submitted electronically (via e-mail or fax) at this time because of the requirement that they be signed by the claimant, and because of the necessity of accurately documenting receipt date and time.

Chapter 4.92 RCW charges the Risk Management Division (RMD)with responsibility for processing citizens' tort claims against the state, setting self-insurance premiums and administering payment of claims through the liability account. RMD objectively determines whether the state is liable for claimed injuries, admits liability when it is substantiated, denies liability when it is not substantiated, and fairly compensates claimants for their damages. The Risk Management Division strives for efficient, timely service to the public and careful stewardship of the state's resources.
For the convenience of the public, RMD offers several tort claim documents on this web site:
- Standard Tort Claim Form (State Form 210). This form is for personal injury, bodily injury, property damage, and most non-vehicle related incidents in which a claimant believes an injury is the fault of a state agency or employee.
- Medical Release Form. Claims for bodily injury should be accompanied by a signed medical release form. This enables investigators to gain access to medical records that will assist them in determining the nature and extent of the injuries. Submitting the release along with the claim form will help RMD process the claim more quickly.
- Instructions for completing the Standard Tort Claim Form. These are step-by-step directions for supplying the information needed to evaluate a claim, including examples.
- Vehicle Accident Tort Claim Form (State Form 138). This form is for claims of damage resulting from an accident involving a vehicle driven by a state employee.
- State Driver Vehicle Accident Report (State Form 137). This form is for use by state employees only to report their involvement in vehicle accidents while driving in a state vehicle on state business.

The length of the investigation varies greatly depending on the complexity of the issues and the availability of documents and witnesses to substantiate causation and damages. A claim can be closed more quickly when it initially provides all relevant information for the investigator's consideration.
