| 4.3.5.1.1 | Authority to Pay - Certification of Claims and Judgments | Effective Date: | Oct. 1, 1988 |

Payments of claims and judgments arising out of tortuous conduct or under and pursuant to 42 U.S.C. Sec. 1981 et seq. are not to be made by any agency, except the Department of General Administration, Office of Risk Management. The State Risk Manager or authorized designee may authorize and direct payment of monies from the Tort Claims Revolving Fund, only when: |

4.3.5.1.1.a |
The agency head or authorized designee certifies to the State Risk Manager that a claim has been approved for settlement under the authority of RCW 4.92.140, and such certification has been attested to by the Attorney General. |

4.3.5.1.1.b |
The Clerk of the Court has made and forwarded a certified copy of a final judgment in a court of competent jurisdiction and the Attorney General certifies that the judgment is final and was entered in an action based on a claim arising out of tortuous conduct or under and pursuant to 42 U.S.C. Sec. 1981 et seq. |
